Terms of service
The terms for using Pocket Agency.
Effective October 24, 2026
These Terms are an agreement between you and Paladin House Inc. (“Pocket Agency,” “we,” “us”), which operates Pocket Agency at thepocketagency.com. By creating an account or using Pocket Agency, you agree to these Terms. If you use Pocket Agency for a business, you confirm you can agree to them on its behalf.
Questions? Email hello@thepocketagency.com.
1. The service and your account
What Pocket Agency does. Pocket Agency studies your business from your website and public information, chooses one marketing move each week, and prepares finished materials for it, such as a social post, an ad, an email or a caption. It uses artificial intelligence, including services from third-party AI providers, to do this.
One move a week. You get no more than one new move each week while your plan is active. We may change how moves are chosen and what they include as we improve the service.
Who can use it. You must be at least 18 and using Pocket Agency for a business you own or are authorized to represent. Pocket Agency is not for personal or household use.
Your private link. Your workspace is reached through a private link we email you. Treat it like a password. Anyone with the link can see and act in your workspace. Tell us right away at hello@thepocketagency.com if you think someone else has it, and we’ll issue a new one.
Accurate information. Keep your email and business website current. We rely on what your website and public sources say, and on what you tell us.
2. Plans, billing and cancellation
Price. Pocket Agency is $99 a month, plus any sales tax. Prices are shown before you sign up. We’ll give you at least 30 days’ notice by email before a price change applies to you.
Founding price. While the founding offer lasts, our first 50 subscribers pay $49 a month, plus any sales tax, for their first 12 monthly payments. After that the regular price applies. The founding price is shown at checkout when it applies.
Free first week. New subscribers get the first 7 days free. You add a card at signup. If you don’t cancel before the free week ends, your card is charged your plan’s monthly price and then every month on the same date until you cancel. We’ll email you about 3 days before the free week ends.
Payments. Payments are processed by Stripe. We never see or store your full card number. By subscribing you authorize recurring monthly charges. Charges appear on your card statement as POCKET AGENCY, or sometimes PALADIN HOUSE, our parent company.
Cancel anytime. Cancel from Account & Billing in My Pocket Agency. Your plan stays active through the end of the period you’ve paid for, then stops. New moves stop when the plan ends. Your finished work stays available in your workspace for at least 12 months.
Failed payments. If a payment fails, we’ll email you and new moves pause until the payment goes through. Stripe will retry the charge.
Refunds. Fees are not refundable, except where the law requires a refund or we decide to issue one.
Taxes. Stripe calculates and collects sales tax where it applies. You’re responsible for any other taxes on your use of the service.
3. You review and approve everything
Nothing is published for you. Pocket Agency prepares materials. You decide whether, where and how to use them. We don’t post, send or publish anything on your behalf.
Check before you publish. Before you use any material, review it for accuracy, including prices, offers, hours, claims and contact details, and make sure it suits your business and follows the rules of the platform where you post it. AI can make mistakes. You are responsible for what you choose to publish.
What you give us. You may give us your website, logo, photos, notes and other materials. You confirm you own them or have permission to use them, and that using them in your marketing won’t violate anyone’s rights or the law.
Permission to use your materials. You give us permission to use your materials only to provide Pocket Agency to you, including to analyze your business and make your moves. This permission ends when you delete your account, except for copies we must keep by law or in backups for a limited time.
Changes. You can ask for one change to each move’s words or picture. The strategy of the move stays the same. A request for a different move is saved for a future week.
4. Who owns what
Your materials are yours. Your logo, photos, trademarks and business information stay yours.
Your ads are yours. When we deliver finished materials made for your business, such as ads, posts, images, headlines, captions and emails, we assign to you all rights, title and interest we have in them and are able to transfer. You may use, copy, change, publish and sell with them, commercially and without limit, including after your plan ends. You don’t need to credit Pocket Agency.
AI and copyright. Parts of your materials are made with AI. Under current U.S. law, material made by AI without enough human authorship may not be protected by copyright. We don’t promise that any material is unique, copyrightable or protectable as yours alone. Other businesses may receive similar images or wording, including from Pocket Agency or other AI tools.
What Pocket Agency keeps. We keep all rights in Pocket Agency itself: our software, website, prompts, strategy frameworks, templates, workflows, quality checks and know-how, and anything we develop from them. These Terms don’t give you any right to them beyond using the service.
Learning to do better work. We may use what we learn from running the service, including how moves perform and the feedback you give, to improve Pocket Agency. We won’t publish your materials or identify your business to others without your permission.
Showing your work. With your written permission, and only then, we may show your materials as examples or case studies.
5. Other people’s rights
What we check. We design Pocket Agency to avoid using other people’s protected material. Every finished image is checked for other companies’ logos and brand marks, owned characters and mascots, likenesses of recognizable people, recreations of known artworks or photographs, and other companies’ famous slogans. Material that fails is regenerated or replaced before you see it.
No guarantee. Automated checks can miss things. We can’t guarantee that materials never resemble something that belongs to someone else. That’s one reason you review everything before you publish.
If you think something is wrong. If you believe a material may infringe someone’s rights, don’t use it, and tell us at hello@thepocketagency.com. We’ll make a replacement for that move at no charge.
Complaints from rights holders. If you believe Pocket Agency material infringes your copyright or trademark, email hello@thepocketagency.com with what the material is, where you saw it, what right you hold, and how to reach you. We’ll review it promptly, remove or replace material we’re responsible for where appropriate, and tell the owner who used it.
6. Using Pocket Agency fairly
Don’t use Pocket Agency to:
- market a business you don’t own or represent, or impersonate someone else;
- make false, misleading or deceptive claims, including invented reviews or endorsements;
- promote anything illegal, or anything the AI providers we use prohibit;
- infringe anyone’s intellectual property, privacy or publicity rights;
- copy, resell or rebuild Pocket Agency, or extract its prompts, methods or data; or
- interfere with the service, test its security without permission, or get around its limits.
We may suspend or end an account that breaks these rules or puts the service, other owners or the public at risk. Where we can, we’ll tell you why first and give you a chance to fix it.
7. Limits of our responsibility
No promised results. Marketing results depend on many things outside our control. We don’t promise any number of customers, sales or views.
Provided as is. POCKET AGENCY AND ITS MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.
Your remedy for a bad move. If a move or material is defective, inaccurate or may infringe someone’s rights, your remedy is that we replace it, or, if we can’t, refund that month’s fee.
Cap on liability. TO THE FULLEST EXTENT THE LAW ALLOWS, POCKET AGENCY’S TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE GREATER OF THE FEES YOU PAID IN THE 3 MONTHS BEFORE THE CLAIM OR $100. WE AREN’T LIABLE FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.
Your responsibility to us. You agree to defend and reimburse Pocket Agency for claims and costs that come from materials you supplied, materials you changed, how and where you published materials, or your breaking these Terms or the law.
Where the law differs. Some places don’t allow some of these limits. In those places they apply only as far as the law permits.
8. Everything else
Privacy. Our Privacy Policy explains what we collect and how we use it.
Emails. We send service emails about your account, your moves and your billing. They’re part of the service.
Changes to these Terms. We may update these Terms. For a material change, we’ll email you at least 14 days before it takes effect. If you keep using Pocket Agency after that, the new Terms apply. If you don’t agree, cancel before then.
Ending the agreement. You can cancel anytime (section 2). We may end the service for you with 30 days’ notice, or right away for a serious breach of these Terms. Sections 4, 5, 7 and 8 continue after the agreement ends.
Changes to the service. We may change, add or remove features. If we stop offering Pocket Agency, we’ll give you at least 30 days’ notice and refund any prepaid fees for the unused period.
Governing law. These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules.
The whole agreement. These Terms and the Privacy Policy are the whole agreement between you and Pocket Agency about the service. If a part is unenforceable, the rest still applies. Not enforcing a part isn’t a waiver. You may not transfer this agreement without our consent; we may transfer it with our business.
